Definitions
- Any reference to the company / seller shall mean Milsport of 5 Christies Court, 33a Youngmans Close, Enfiled, Middx, EN2 ORF who sell specialist automotive parts and accessories in the course of their trade or business.
- Buyer/purchaser shall mean any person, sole trader, partnership, business or other entity detailed in the appropriate section of the sales invoice. Where the buyer /purchaser does so in the course of a trade, profession, vocation (where the buyer is a specialist) it is agreed that such a buyer will be known as a trade buyer. Where a person deals entirely as a consumer, statutory rights shall remain unaffected.
- Goods or equipment shall mean the items detailed in the relevant section of the sales literature/web site.
- Price shall mean the amount due for purchase and shall exclude VAT (or any other taxes due) unless otherwise stated.
General
- “Working day “ shall mean any day excluding Saturdays, Sundays or public holidays.
- Brochure descriptions, web site information or any sample are indicative only and any weights, specifications and technical data (whether relating to performance or otherwise) are for guidance only and shall not form a description within the meaning of the Sale of goods Act.
- Milsport reserves the right to amend technical or clerical errors without notice.
Guarantees
- Purchasers are reminded to complete all warranty documentation upon receipt of goods.
Limitations upon liability.
- Advice given by any person or agent acting on behalf of the company is based entirely upon information supplied by the purchaser with no inspection undertaken. No liability can therefore be accepted by Milsport for incorrect advice given and all such advice should be checked by the purchaser prior to order.
- For trade buyers Milsport is excluded from any liability, howsoever arising, in respect of any express or implied condition, warranty or term, statement, representation whether statutory or otherwise relating to the goods supplied. The trade buyer accepts that he is best placed to insure against losses which arise by virtue of any breach of this agreement and warrants that he carries adequate insurance in this respect.
- Compatability of goods is not guaranteed where alterations or modifications have been made to vehicles and Milsport shall, in such circumstances, and entirely at it’s discretion, issue a refund or credit to the purchaser except where goods have been specifically ordered for the purchaser where no refund or credit will be given.
- Where goods purchased by the buyer are alleged to be defective, the purchaser agrees to return such goods to Milsport for inspection (without the seller replacing the goods prior to such inspection). The purchaser also confirms it is reasonable for Milsport to repair or replace (at it’s option) such defective goods. The purchaser also accepts it is reasonable to inform Milsport of any such defect or failure prior to contacting any third party.
- Milsport will not be liable in respect of failure to supply or other interruptions caused by matters beyond it’s control, such as strikes, civil disputes, acts of God, war or any action by third parties.
Payment Terms
- Unless otherwise stipulated all accounts are strictly net and payable with order or in accordance with the trade buyers account conditions.
- Where default occurs in respect of a trade buyer, default interest shall become payable at the maximum amount payable under the terms of the Late Payment of Commercial Debts (interest) Act 1998. Or where the buyer is a consumet interest shall be charged at 2% above the base rate set by Barclays Bank Plc as set at the time.
Title and Delivery
- Title of the goods shall not pass to the buyer until paid for in full.
- The buyer must notify in writing any shortage, breakage or any other discrepancy immediatley or at the latest,
within 5 days, thereafter the purchaser shall become liable for any such discrepancy.
Cancellation of Orders and Liability
- Special order goods shall not be returned under any circumstances
- Once any goods have been dispatched, cancellation of the order will be subject to a restocking charge of not less than 15% of the value of the order.
- Any goods returned after cancellation of an order must be recieved in as new condition in their original packaging (and without having been installed) with all relevant seals and enclosures intact. The return of such goodds shall be entireley at the consumers/purchasers own expense.
- Milsport shall effect a refund in respect of any monies owing to the consumer in respect of the goods within 30 days from cancellation of the contract. The refund will be subject to any charges as specified in clause (2).
- Any refund will be paid to the purchaser using the original method of purchase.
- The original Milsport purchase invoice is required on all returns.
Returns
Goods which prove unsuitable may be returned for refund, credit or exchange if they are returned to ourselves within 5 days of receipt.
Subject to the following conditions.
- Items are returned carriage paid.
- Items are recieved, unused, unfitted and in a saleable condition.
- Items are returned with all original packaging and enclosures in good condition.
- We reserve the right to levy a charge to replace product packaging which is damaged or defaced.
- All returns must be accompanied by the senders name and address, original invoice and reason for return.
- We cannot accept responsibility for returned parcels which are undelivered, please keep your proof of postage,
you may need it in the event of a claim.

- Please allow up to 14 days for delivery (not for parcel value excess of £27.00)
Special Delivery
- To UK mainland, Northern Ireland, I. of Man, I of Wight, Channel Islands, guaranteed next working day.
- To Scottish highlands and isles 2-3 working days.
- Up to 500grams £7.50
- Up to 1kg £8.50
- Up to 2kg £10.00
- Insured up to £250.00 per parcel (additional insurance at extra cost).
- Special delivery parcels require a signature upon delivery.
Carrier Services
For heavier parcels we use either Omega Securicor Express (DHL), Parcel Force or TNT.
These companies offer five basic packages.

Goods can only be delivered to the Registered Address of the card holder
(as held with the card company) or in the case of payment by cheque we
require 8 working days for the cheque to clear before dispatch. |
